Hero DVO, LLC (d/b/a “Hero Practice Services”), and the practices it manages (collectively, “Hero”, “we”, “us”, or “our”), respect your privacy and are committed to protecting it.

This Privacy Policy describes the types of information we may collect from you or that you may provide when you use or visit our websites, www.heropracticeservices.com  and http://www.kidsdentalvisioncare.com(our “Websites”), and our practices for collecting, using, and disclosing that information, as well as the choices you have with regard to the information we maintain.

This Privacy Policy applies only to information we collect on our Websites, including information you provide to us.

Please note, this Privacy Policy does not apply to our use, collection, or disclosure of protected health information (“PHI”) pursuant to the Health Insurance Portability and Accountability Act (“HIPAA”). To the extent there is a conflict between the terms of this Privacy Policy and the Notice of Privacy Practices with respect to our use or disclosure of PHI, the Notice of Privacy Practices controls. This Privacy Policy is incorporated into and made part of our Terms of Use. By accessing or using our Websites, you acknowledge our collection, use, and disclosure of your information in accordance with this Privacy Policy and consent to our Terms of Use. If you do not agree to our Terms of Use, you may not use our Websites.

This Privacy Policy is subject to change at our discretion. We will indicate changes to the Privacy Policy by updating the “Effective Date” at the beginning of the policy. Your continued use of our Websites after any update to this Privacy Policy will constitute your acceptance of our changes.

Information We Collect About You and How We Collect It

With respect to this Privacy Policy, personal information (“Personal Information”) generally means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly with you. Personal Information may be collected directly from you when you provide it (e.g., name, email address, telephone number) and/or automatically as you navigate through our Websites (e.g., IP address, browser characteristics, usage details). Personal Information does not include information that is de-identified or aggregated. We may combine your Personal Information with data we obtain from across our different Websites. We will disclose Personal Information to the extent necessary to comply with a subpoena, court or administrative order, law, rule, regulation, or similar requirement that we believe in good faith legally obligates us to disclose it.

We may use Personal Information to the extent necessary to protect our Websites, our rights, and to avoid or minimize our liability. For example, we may use Personal Information to identify someone who is using our Websites for an illegal purpose and disclose it to law enforcement or our attorneys to consider taking legal action.

We will not sell personal information obtained for text message opt-in consent purposes to third parties.

Web Technologies

We may use Web Technologies, managed by vendors or other service providers, on certain portions of our Websites.

The Web Technologies we may use generally consist of small data files stored in a browser file on a device’s hard drive, small graphic images that are embedded in web pages or emails, or scripts that are temporarily downloaded onto your device. Most browsers automatically accept certain Web Technologies, but you usually can change your browser settings to remove or reject such Web Technologies. You should remember, however, that disabling Web Technologies may limit your ability to access or use portions of our Websites, and certain offerings or features on our Websites may not function as intended.

We may use technology vendors in connection with your activity on certain portions of our Websites. The tools these vendors provide help us control how Website User Data is collected by Web Technologies. They also allow us to limit certain types of Website User Data, such as details about your activity on our Websites, from being transmitted to other parties.

Additionally, we or external parties, on our behalf, may collect Personal Information, including Website User Data, about your online activities over time and across different online services.

We may use Google Analytics or other providers for analytics services. Your Rights & Choices

We strive to provide you with choices regarding the Personal Information we collect through our Websites. Our Websites may have settings available to you, depending on the Website, to allow you to set preferences.

Direct Marketing: If you receive marketing emails from us, you may unsubscribe or opt out through the email’s instructions. Please note that regardless of your email preferences, we may send you notifications pertaining to our Websites, such as a revision to our Terms of Use or this Privacy Policy or other formal communications relating to Websites you have used. Please also note that even if you unsubscribe, we may still send you transactional or administrative communications, including, for example, to respond to your requests, provide you with information on products you order or appointments you make, and manage your transactions.

Web Technologies / Internet-Based Marketing: You may opt-out of certain Web Technologies by visiting the opt-out services provided by the Digital Advertising Alliance (“DAA”), including the DAA’s Ad Choices program. Opting out through these services does not mean you will no longer receive advertising from us, or when you use the Internet.

Some of our Websites also provide you with the opportunity to manage your settings related to Web Technologies, including cookies. To opt-out of the use of certain Web Technologies, please click on the “Do Not Sell or Share my Personal Information” link available in the footer of our Websites.

Do Not Track Policy: Some browsers have incorporated “Do Not Track” (“DNT”) features that can send a signal to the websites you visit indicating you do not wish to be tracked. Because there is not a common understanding of how to interpret the DNT signal, our Websites do not currently respond to browser DNT signals. Retention of Personal Information

We retain Personal Information for as long as necessary to comply with our legal obligations, resolve disputes, enforce our agreements, and other legitimate and lawful business purposes. Because these needs can vary for different data types, actual retention periods can vary significantly based on criteria such as whether your Personal Information is reasonably necessary to manage our operations, to manage your relationship with us, or to satisfy another purpose for which we collected the information; whether your Personal Information is reasonably necessary to carry out a disclosed purpose that is reasonably compatible with the context in which we collected the information; whether the Personal Information is reasonably required to protect or defend our rights or property; or whether we are otherwise required or permitted to keep your Personal Information by applicable laws or regulations. Where Personal Information is used for more than one purpose, we may retain it until the purpose with the latest period expires.

Children Under the Age of 18

Our Websites are not intended for or directed to persons under 18 years of age. If you are under the age of 18, you may not submit Personal Information through our Websites. Hero does not knowingly collect Personal Information through its Websites from any person under the age of 18.

Data Security

Safeguarding Personal Information is important to us. While no systems, applications, or websites are 100% secure, we take reasonable and appropriate steps to help protect Personal Information from unauthorized access, use, disclosure, alteration, and destruction.

Other Websites or Services

This Privacy Policy does not apply to the practices of companies we do not own or control. Our Websites may provide a link or otherwise provide access to external websites or services. We provide these links merely for your convenience. We are not responsible for the privacy practices of such other websites or services. External websites and other businesses may have their own privacy policies which are applicable. You should review the privacy policy of the website you’re visiting.

Additional Information for US Consumers

Residents of certain states, including California, Colorado, and Maryland, have additional or different rights under comprehensive state privacy laws. We have described the Personal Information we collect and the sources from which we collect it (“Information We Collect About You and How We Collect It”). We have also explained our purposes for collecting Personal Information and how we disclose it to others (“How We Use and Disclose Information”). Unless otherwise noted, the disclosures in this Section cover our activities in the twelve (12) months preceding the “Last Updated” date above, as well as our current practices.

Selling and Sharing of Personal Information

When we use the terms sell or sale, we mean for valuable consideration and not monetary value. In addition, certain state laws may regulate the use and disclosure of Personal Information for “targeted advertising” as defined by applicable law.

We do not have actual knowledge that we sell or share the Personal Information of consumers under 18 years of age.

California Privacy Rights

This Section is provided pursuant to the California Consumer Privacy Act, as amended (the “CCPA”), and describes how Hero may collect, use, and disclose Personal Information of consumers that reside in California. Please note certain information we collect, use, and disclose is considered PHI, as described above, and is therefore covered by our HIPAA Notice of Privacy Practices.

If you are a resident of California, you have the right to submit certain requests relating to your Personal Information as described below. To exercise your CCPA rights, please submit a request by email to ccpa@herodvo.com or by calling us at 1-855-278-5468. Please note that, depending on the nature of your request, you may be asked to provide information to verify your identity before your request can be processed.

You may designate an authorized agent to make a request on your behalf; however, you will still need to verify your identity directly with us before your request can be processed.

If you would like to submit a request pursuant to your rights under HIPAA instead of CCPA, please contact us at privacy@herodvo.com and indicate that you are making a HIPAA request.

Right to Know. You have the right to know what Personal Information we have collected about you, which includes:

  3. Our business or commercial purposes for collecting, selling, or sharing Personal Information.
  4. The categories of recipients to which we disclose Personal Information.

  6. The categories of Personal Information that we disclosed for a business purpose, and for each category identified, the categories of recipients to which we disclosed that particular category of Personal Information.

Right to Delete Your Personal Information. You have the right to request that we delete Personal Information we collected from you, subject to certain exceptions.

Right to Correct Inaccurate Information. If you believe the Personal Information we maintain about you is inaccurate, you have the right to request we correct that Personal Information.

Right to Opt Out of Sales and Sharing of Personal Information. You have the right to opt out of the sale or sharing of your Personal Information and to request that we do not share your personal information for cross-context behavioral advertising, which only applies to Hero in the context of Web Technologies, such as cookies. To opt out of the sale or sharing of your personal information via cookies and other Web Technologies, please click on the “Do Not Sell or Share my Personal Information” link in the footer of our Websites. You may also opt out of the sale or sharing of your Personal Information through an opt-out preference signal. In order to process your request through an opt-out preference signal, you must use a browser or extension supporting the preference signal.

Right to Limit Use and Disclosure of Sensitive Personal Information. We do not use or disclose sensitive Personal Information for purposes to which the right to limit use and disclosure applies under the CCPA.

Right to Non-Discrimination for the Exercise of Your Privacy Rights. If you choose to exercise any of the privacy rights described above, we will not discriminate against you.

California Shine the Light

We do not share Personal Information with third parties or affiliates for those third parties’ or affiliates’ own direct marketing purposes. Californians may request information about our compliance with this law by contacting us at ccpa@herodvo.com.

Information for Users Outside the United States

Please note that Hero is based in the United States and that Personal Information submitted to our Websites will be transferred to a server in the United States and will be processed by staff operating in the United States. By submitting Personal Information through the Websites to Hero, you consent to this transfer, processing, and storage. If you live outside of the United States, please be aware that the data protection laws and regulations that apply to your Personal Information transferred to the United States may be different from the laws in your country of residence.

Changes to Our Privacy Policy

Hero reserves the right to change this Privacy Policy from time to time. It is our policy to post any changes we make to our Privacy Policy on this page. If we make material changes to how we treat users’ Personal Information, we will notify you by updating the effective date of this Privacy Policy. The date the Privacy Policy was last revised is identified at the top of the page. You are responsible for periodically visiting our Websites and this Privacy Policy to check for any changes.
